The Legal Advice which we have overwhelmingly received is that if a particular website , like the Quackometer ( a.k.a "Le Canard Noir" ) , unlawfully defames another concerned party (like the Society of Homeopaths) while still being independently hosted by yet another third party (like Netcetera) . . . then the third party (in this case Netcetera) is deemed fully liable to pay out appropriate financial damages to the Defamed Party , effective from the date which it is formally notified of the alleged defamatory act.
If it can also be further proven that the website hosting service (in this case Netcetera) additionally knowingly provided Search Engine Optimization (SEO) Services as part of it's package to a Frequently Defaming Website (in this case the Quackometer) , then the website hosting service (in this particular case Netcetera) could also be liable for Substantial Retrospective Punitive Damages , in addition to it's Definite Liability emanating during the Post-Notification Period.
To this effect , in our opinion , the Society of Homeopaths was perfectly right to threaten Severe Legal Action against Netcetera ; and Netcetera was equally right to order that the said Defamatory Material from Quackometer ( a.k.a "Le Canard Noir" ) be immediately taken down from it's very own Netcetera Commercial Servers.
